Terms of Service
By using the services provided, making payments, and/or making deposits for our services, you hereby agree to the Terms of Service below:
This agreement is between Lights of Winter LLC (the "Business") and yourself (the "Client").
The Client is hiring the Business for the services described in this contract. If you disagree with any of the terms outlined, please refrain from using our service.
Terms
Definitions
In this Service Agreement, “you” and “your” refer to each “client.” Including each (agent) you designate to act on your behalf. “Lights of Winter LLC” herein shall refer to its business, company, its members, managers, team members and installers. This Agreement explains our obligations to you, and your obligations to us in relation to the service(s) you purchase. If you designate a person to act on your behalf, you agree that this person is your agent with full authority to act on your behalf with respect to such services and your home. Lights of Winter LLC will not accept or schedule an installation without an agreement and payment of required deposit minimum. By using our service, you agree to the terms of this agreement, without modification by you or your designated agents.
Estimates
Lights of Winter LLC will provide an estimate of cost and material usage to the client. The estimate may be written or delivered verbally. Lights of Winter LLC will use the client’s verbal description or photo to approximate as closely as possible the described layout; however, Lights of Winter LLC will not be responsible for any changes in design, product, color, or location after installation has begun. If client requests changes to any or all portions of completed work, client will be responsible for all original and changed costs. Color themes provided on concept are artist suggestion only. Concepts are provided to offer a visual representation; actual design may vary. Electrical cords and electrical accessories are included in the estimated price; however, additional charges will apply for any items which extend 50 feet or more from an originating power source or if excessive or unique electrical supplies are needed. The client will be notified of any surcharges. For safety and quality purposes, all lights, electrical cords, and accessories must be provided or approved by Lights of Winter LLC. All line items are a la carte. Final color choices must be determined at time of invoice. The estimate is an approximated price and may vary from the actual price. Client requested additions and/or changes to the original estimate may result in increasing the actual price. All pricing discussions must be made directly with the Project Manager or the Owner (407) 564-6787. Lights of Winter LLC’s Field Staff (Installers) are not permitted to calculate pricing except for the Project Manager.
Invoices and Deposits
Client will be invoiced before the installers begin on all installations and takedowns. Lights of Winter LLC requires a minimum $100 deposit, unless otherwise specified, in order to guarantee your installation and the remainder of your payment is due no later than 10/1/2025, unless otherwise specified.
Payment will be made to the Business via cash, check, an approved payment card, or by any other payment method determined by the Business.
Standard Pricing Coverage
Our standard pricing includes:
1.) Single-time installation of lights according to a layout planned by Lights of Winter LLC and approved by the Client before invoice.
For Holiday Lighting: From the installation date through no later than February 15th of the following year.* Lights of Winter LLC will fasten light strands to roof edge, facia board, gutter or similar flat surface using white clips or hot glue and secured with zip ties where needed including corners and peaks. If standard fastening methods (such as hot glue or clips) are not possible, additional charges may apply. Garland and wreaths may require drilling anchors to ensure items are safely and securely installed. These anchors are included in the cost.
2.) For Holiday Lighting and Event Lighting: Single-time Take Down and boxing up of lights and electrical accessories. Tote(s) are included in cost of service. Storage may be provided for an additional charge or included in your invoice.
3.) Sales tax, if applicable.
*Future reinstallation is available for all items purchased through Lights of Winter LLC at a rate determined by the initial purchase total of each item. This rate is subject to change to keep up with the cost of doing business (ex. inflation, labor, rentals, etc.)
Storage (if purchased)
Lights of Winter LLC agrees to store the Clients property as described in the invoice for a period of up to one (1) year; until the earlier of the next holiday lighting installation or January 31st of the following year. Client herby agrees to a recurring charge of $107/per item/per year, including tax, for storage. This amount is subject to change at any time. Should the Client decide not to use Lights of Winter LLC for the current years holiday lighting installation, Client must retrieve all items no later than January 31st of the following year to avoid an additional charge of $107/per item/per year, including tax.
For safety and security reasons, Client may only store items provided by Lights of Winter LLC during holiday lighting services and may not store personal totes or items as part of this agreement.
Client may temporarily retrieve items from Lights of Winter LLC during the year, after providing at least 48 hours notice to Lights of Winter LLC.
Lights of Winter LLC may temporarily restrict access to items at any time for security reasons, including but not limited to inventory stock-take, weather, and staffing.
Customization
Most of our lighting is custom cut and/or custom colored. Due to the unique nature of our services and the character of custom lighting, we will make a reasonable effort to produce a clean, custom look. Cords, cables and extra lights may still be visible in some areas. Concept drawings provided do not represent the actual product and are merely a visual representation of a color scheme offered.
Payments
Payments will be made to the Business via cash, check, an approved payment card, or by any other payment method determined by the Business.
Payments not received by the due date as stated on the invoice may be subject to loss of discounts and a $10.00 per day late penalty. Failure to Pay-In-Full by the due date as stated on the invoice may result in forfeiture of installation.
Disputes and/or charge-backs to the credit card company will result in a $100.00 fee.
Check payments that do not clear the bank will result in a $100.00 return check fee.
Scheduling
Lights of Winter LLC will provide an estimated date of installation typically 14 days in advance but can be sooner or later based on operational conditions. Holiday Installation dates may be scheduled anytime between 10/1-12/15.
The estimated install date is subject to change based on weather, routing efficiency, available labor, etc. If the original install date is not possible, Lights of Winter LLC will attempt to install as closely as possible to the originally scheduled date. Reasonable efforts will be made to accommodate requested install dates when possible, but a requested date is not guaranteed.
Takedowns are not scheduled due to time constraints and routing efficiency. Reasonable efforts will be made to accommodate requested takedown dates when possible, but a requested date is not guaranteed. For holiday Lighting: Takedowns commence between 1/1-2/15. Client will typically be contacted between 1-3 days prior to takedown.
Warranty
Lights of Winter LLC lighting packages come with a manufacturers 2-year warranty which covers defects of all light strands, timers, extension cords, connectors, bulbs and fuse replacement.
The warranty does not include damage of any kind including but not limited to; animals, theft, changes by client, negligence, Acts of God, etc.
Service Calls
Lights of Winter LLC will test all lighting at completion of installation and will leave project fully functional.
For Holiday Lighting: Lights of Winter LLC will provide the client with up to three (3) free service calls between install date and December 23rd at 5:00 pm Eastern Standard Time; however, a $50.00 per hour fee with a minimum of 1 hour will apply to repairs that result from the following:
Weather, tampering by animals (such as chewing through wires), Acts of God, GFCI Trips, Theft, Damage from landscapers or landscaping, changes made by Client (such as tethering personal/additional lights to the installation provided by Lights of Winter LLC), Bulb/Fuse replacement and/or troubleshooting of non-working lights, extension cords, timers and connections purchased by client (Materials that were not provided by Lights of Winter LLC). Client may be charged cost of new materials if needed for repairs in addition to any applicable service fees.
There will be no service calls between 12/23-12/31 as we would also like to enjoy the holidays with our families.
Electricity and GFCI’s
The homeowner must provide Lights of Winter LLC clear access to safe and adequate electricity commensurate with the volume of lights requested by the client. Lights of Winter LLC will require enough free circuits to successfully handle the electrical load of the lighting package. High wattage devices such as refrigerators or hair dryers must not be tethered to the lighting package circuits.
Lights of Winter LLC will not be held responsible for inadequate, faulty, or overloaded electrical sources at the place of service.
If circuit breakers frequently need to be reset, this is often an indication of inadequate power supply and may require a service call to locate additional clean circuits and redistribute power resulting in a fee. Client may be required to provide electrical connection from inside the house.
Clients requesting large lighting packages may need to consult with their electrician to provide additional power sources commensurate with package needs.
Persistent moisture such as rain or from landscaping sprinklers will create an increase in electrical resistance, up to double the load of the lighting package in dry weather. If the lighting package frequently trips GFCI's/circuit breakers in wet weather or while running irrigation, the client will be responsible for providing additional clean circuits to Lights of Winter LLC for redistributing the power load, continue to reset the GFCI's/circuit breakers as needed, and/or disabling sprinklers for the season. Additional charges may apply for mitigation efforts.
Lights of Winter LLC makes no guarantee of water-resistance or water-proofing of any items. Lights of Winter LLC will herby retain the right, at its discretion, to remotely and/or physically disable the installation in the event of rain to limit GFCI trips.
Clients should not tether personal lights or appliances to the lights installed by Lights of Winter LLC as it may result in exceeding fuse or circuit limits and may require a service call resulting in a fee.
Damages
Lights of Winter LLC is not responsible for damages or repairs due to animals, weather, natural causes, or negligence including but not limited to paint chipping, damaged gutters, damaged roofing shingles, damaged architectural foam, hydraulic fluid leaks, etc.
The Client agrees that normal wear and tear are to be expected and may not be used against the company in any way including but not limited to lawsuits, refunds, or reviews. Normal wear and tear includes but is not limited to broken shingles, scuffs and scrapes, ruts, broken branches/flowers.
Lights of Winter LLC makes no guarantee of wind-resistance and/or water-resistance for any items, expressly or implied. At the determination of Lights of Winter LLC, certain large items (i.e.. wreaths) may be temporarily removed or held from installation if the area is forecasted for hurricane conditions at any point during the duration of this contract.
Termination of Contract
The Contract ends on March 1st, 2026 unless one of the parties ends the contract before that time. If one of the parties chooses to end the Contract prior to Project completion, the Client is responsible for 50% of the invoice total and/or paying for all work and costs incurred up until that date.
Modifications
Lights of Winter LLC may revise these terms and conditions at any time without notice. By using this Service, you are agreeing to be bound by the then-current version of these terms and conditions.
Each party has the authority to enter into this Contract and to perform all of its obligations under this Contract.
Additional Stipulations
Lights of Winter LLC reserves the right to reject service to any property deemed unsafe by Lights of Winter LLC. If property is deemed unsafe by us, we will refund 50% of the client’s prepaid balance.
Lights of Winter LLC cannot guarantee consistent light bulb orientation due to twisting nature of light strands, gutters, roof design, etc.
Lights of Winter LLC reserves the right to take and use photographs and/or video of the client’s property for marketing and media purposes.
Lights of Winter LLC is hereby granted the sole and exclusive right in perpetuity to use, modify, alter or make additions to all items previously purchased from Lights of Winter LLC, indefinitely, for the purpose of Future Year Reinstallations, upgrades, repairs, and all future service agreements. This right may be be further defined or terminated in future service agreements. If it is determined at any time by Lights of Winter LLC that another person, company, or entity not affiliated with Lights of Winter LLC has violated this right, the Client may forfeit 100% of their balance and may be deemed ineligible for Future Year Reinstallations.
Binding Contract
THE ABOVE ARE TERMS AND CONDITIONS OF SALE THEY MUST BE READ AND AGREED UPON AS THEY ARE A BINDING LEGAL CONTRACT.
